Abstract

This paper deals with the effectiveness of previous life research in the face of the position of
the courts: Superior Court of Justice (STJ) and the Court of Justice of the Federal District and
Territories (TJDFT). Such an approach is necessary due to the large number of candidates that
are contraindicated in the evaluation of past life by the institutions, but which continue in the
contest due to varying understandings of the Brazilian justice, which often leads to access to
security by people with involvement criminal. The objective is to analyze the damage caused
to the PMDF, its members and society as a whole, in view of the access of people who would
not have a previous life compatible with someone who wishes to enter a security institution.
This task will be achieved through bibliographical and jurisprudential review, passing by
indoctrinators in the area of Law and Intelligence of Public Security. In addition, the
methodology employed will be exploratory, consisting of the collection of judgments in order
to identify the jurisprudential position contrary or favorable to the administrative decision.
Finally, the study showed the relevance of social investigation and the full support of the
judiciary, requiring special attention focused on how to conduct the investigation in order to
support the administrative and judicial decision.
