Abstract

In the scenario of demands that require an efficient administration, the expenditure of human and financial resources, in administrative functions, in conducting a police investigation that will not fulfill its purpose is not tolerable. Thus, allegations of very slight bodily injury to the detriment of in-service military police officers resulting from the custody hearing need a quick response, and the most viable option is the establishment of an administrative procedure that enforces the spirit of the norm contained in art. 209, § 6, of the Military Penal Code and maintain a disciplined and respectful prisoner. In order to find the answer to this question, the present research will be exploratory and bibliographical in nature, based on legal predictions and doctrinal concepts, accompanied by a quantification of data from the investigations instituted as a result of the records of the Núcleo de Audiência de Custódia (NAC), forwarded to PMDF in the period from October 2015 to September 2016. It should be emphasized that because it is original scientific work, the method used will be of a deductive nature, based on general premises that will serve as a basis for comparison with the data concerning to records of occurrences and inquiries about police actions forwarded from custody hearings, making it possible to reach a specific object: the search for an efficient solution to the Polícia Militar do Distrito Federal. For this will be considered the predictions contained in military criminal legislation, internal legislation and doctrinal concepts.
