Abstract

Military police are subject to various spheres of independent punishment. Administrative misconduct becomes the fifth sphere of punishment that, possibly, a military police officer may be subject to, since it is liable to civil, criminal, administrative liability, in addition to military criminal responsibility and administrative misconduct, which is completely independent And cumulative with the spheres returned. Antirepublican patrimonialism, an expression used by Souza Neto and Sarmento (2017), still persists in the layers of management of the public thing in the Brazilian state, for that reason, the Law of Administrative Improbity was created. This paper addresses the issue of "administrative impropriety within the military police". Such an approach is justified by the increase in convictions for acts of administrative impropriety in which military police officers are guilty. The purpose of this study is to alert the managers of the military police about the need to know the management of the public thing and also the sanctions to which they are subject in case of poor public management. This purpose will be achieved through a bibliographical review of the main doctrinators on the subject, among them some Prosecutors, Attorneys of the Republic, who developed an extensive and deep subject about the discipline, which is still being pacified by doctrine and jurisprudence, There were no pacifications on the subject. Also analyzed in the last topic were cases of military police officers who were convicted of acts of administrative impropriety. The study evidenced that several managers were convicted of acts of administrative impropriety because Law 8.429 / 92, known as the Administrative Improbability Act, better known as LIA, is a relatively new law that covers many situations related to public administration.
